Supreme court cases Essay Example | Topics and Well Written Essays - 750 words

Supreme court cases - Essay Example Dissent opinions among the judges suggest potential existence of flaws and that the judgment could be wrong. This paper reviews the Supreme Court decision on the case of Roe v. Wade with the opinion that the court erred in its decision. The case involved decision on legality of abortion based Texas laws that prohibited abortion. The court ruled against state law and explained that a woman has a right to abortion. The Supreme Court further stated that this right was constitutional, derived from two amendments of the United States’ constitution. â€Å"The Ninth and Fourteenth Amendments,† the court explained, provide for the right to â€Å"personal privacy,† and grants a woman the sole right to make decisions on reproductive issues (United States Confederation of Catholic Bishops 1). The court further explained that the fetus lacks personality and therefore does not have a right to life, an argument to the effect that abortion does not amount to any element of murd er. The court however established a strategy for determining the rights of a woman and rights of the state regarding abortion in which the state has no right over abortion in the first three months of pregnancy. The decision granted the state limited right to protecting the mother’s rights in the second trimester and right in the fetus’ life in the last three months of pregnancy (Gerber 181). ... Interpreting the Tenth amendment together with the Ninth amendment grants states the power to make laws on abortion. The Ninth amendment is clear that recognized rights in the constitution shall not be interpreted to impair another right but the Texas law on abortion was not specifically based on a right. Even though the law prohibited abortion unless the mother’s life was in danger, secondary rights such as rights of the fetus were not primary to the law. This means that the Ninth amendment that limits interpretations of some rights to disadvantage others should have not been applied against the abortion law and abortion laws, having not been provided for by the constitution, should fall within jurisdiction of states (Rechtschaffen and Markell 41). Provisions of the Fourteenth amendment also appear ambiguous to have warranted the Supreme Court’s decision to legalized abortion. While the amendment provides that states should not enact laws that infringe people’s rights, the amendment fails to recognize limits of people’s rights and unless interpreted will other laws, is repugnant to natural justice and other people’s rights. If, for example, that a person’s right is a threat to other people then care must be taken to limit such a right. While this argument does not rely on possible rights of the fetus, it notes that independent reliance on the Fourteenth amendment’s provision for supremacy of constitutional rights was not the right basis. The Texas abortion law would fall under cases of misused Fourteenth amendment rights towards injustice (Miller and Jentz 9). The court’s decision is also contradictory because it reprimanded the Texas’ abortion law for infringing women’s rights but at

The cruel princess :: essays research papers

Essay Question: After days and nights of anguished deliberation", the princess makes her decision of what door she will direct the young man to. What do you think her decision is? Explain, using evidence from the story, to support your opinion. The only crime of the young man was that he loved the princess. Just because of this he was forced to play the game of life and death by the barbaric, uncivilized king who never valued human lives. The king's method of trying criminal was that he had two doors in an arena and behind one door there was a hungry, savage tiger and behind the other a woman picked by him. If the accused person opened the door with the tiger, he was eaten. If he opened the door with the lady - he had to marry her with out any complaints. The accused young man had to depend on the princess's decision, who could've saved the young man's life by telling him which door to open. I think the princess directed the young man to the door of death. The princess that we are talking about was the daughter of the king, so it is easy to see that barbarism was in her blood. She knew the woman that the king picked for the young man and she hated her. The princess believed that the woman that was picked was trying to have an affair with the young man from the begining and the princess never wanted something like this to happen. If she cann't even see the young man talking to some other woman then how can she watch him get married with some one who she hated? To the princess it was not a question of saving the young man from the jaws of death, it was about her own win.

John & John Case

I. Problem: The major issue that Johnson& Johnson (J&J) faces with its face powder is that despite the product’s innovation, a toiletry design and confidence in potential customers, it positions its product line as a cheap skin refresher by using supermarkets as main distributing channels and setting the price range of product cheaper compared to that of competitors sold in department stores, which damages its brand and profits. In order to ensure that J&J makes a success in launching new brand category product with profits, it needs to develop a marketing strategy to make more profits by changing its distribution channels, the price range higher and targeted customers under the toiletry concept. II. Alternatives: ) Position as a premium refresher through department stores channels + Raise awareness of a new product as a premium brand by severing relation with baby powder + Higher margin and potential to raise prices above original margins + Successful upper and middle level cu stomers targeting with high value brand and synergy with J&J brand – High price and little difference with cosmetics may be unattractive to teen and young adults – Fierce Competition with current face powders sold (ex: Angel Face) in the department stores – Losing opportunity to use established strong distribution strength in supermarket channels ) Position as a premium refresh for both young female and adults through department stores + Enlarging market by targeting both teen and young adults and older female, including mothers + Less pressure from mother’s opposed to their daughter’s using cosmetic face powder from compacts + End user’s enhanced purchasing power resulting from targeting older females – Young customer’s alienation from the product due to their tendency not sharing with old generations – More designs and functions for satisfying different kinds of customers in terms of age – Unpromising forecast a bout current cosmetic user’s transition into new product category ) Position as a premium refresher for young adults through supermarket channels + Easy access to the product from potential customers + Differentiation from household items sold in the supermarkets due to high price and premium brand + Strong distribution power by usage of already established supermarket distribution channels – Difficulty in separating its image from grocery items in the supermarkets – Small profit margins compared to that of department stores – Huge advertising cost is unnecessary, unprofitable and ineffectiveIII. Recommendation: I suggest that J&J set a new product line as a premium refresher with higher price by distributing it through department stores. At first, the demand of targeted customers such as teens and young adults is already verified. In order to make more profit with this product, J&J needs to target the market segmentation more specific.Considering most po tential customers are young females living in urban areas with relative economic capability, more profit margin in department stores compared to supermarkets, and a marketing strategy under the toiletry concept, I recommend that J&J change its distribution channel into department store and set the price range higher than the current competitors in the market, thus resulting in more profit margin and boosting an image of brand new product as premium items among young adults-main target customers-in the Philippines. In addition, high end strategy will pave the way for launching J&J’s future youth lines such as body care product with high profit margin and providing high brand image with future customers to J&J’ baby products, not mention to more profit margin and enhanced J&J’s premium brand resulting from department stores distribution.

Doctor Faustus regards himself on a higher level than devils and hell; â€Å" I charge thee to return and change thy shape,/ Thou art too ugly to attend on me; (scene 3, 23-24). He thinks nothing will happen to him; â€Å"Come, I think hells a fable†. His challenge with God progresses throughout the play; he supposes he is more deserving the special dish than the Pope; â€Å"POPE: My Lord, here is a dainty dish was sent to me from the bishop of Milan. FAUSTUS: I thank you, sir. [snatch it] (scene 7, 62-64)† This behavior to Pope is a disrespect to God as well. Narrative Of The Life Of Frederick Douglass - 1170 Words

1. His presence was painful; his eye flashes confusion; and seldom was his sharp, shrill voice heard, without producing horror and trembling in their ranks† (35). Discussion- Douglass uses ethos specially when referring to those who had great authority over him. In chapter 3, he talks about Colonel Lloyd and gives a very elongated description about him. Another example of the use of ethos is when he talks about Mr. Austin Gore the man who replaced Mr. Hopkins. Like he does with Colonel Lloyd, he talks about the authority of this man and about his faithfulness to the colonel. Lastly, Douglass also used ethos when he talks about how he never said anything negative about his owner. This is ethos because it relates to ethics and what was right at the time. He establishes credibility through personal experience and his loyalty towards his superiors. Passage 2 (pathos)- Mr. Severe was rightly named: he was a cruel man. The Leadership Of Steve Jobs - 971 Words

Imagine a world similar to the one you live in now, but imagine that world without your smart phone. For some this may seem like a better place, but for most of us it’s difficult to imagine living in this world. Technology is a major part of our lives because it gives us mass amounts of information at our finger tips. Apple gave us the first smart phone known as the iPhone and leading that company was Steve Jobs. From a startup that began in his garage, Steve Jobs developed one of the most successful companies in the world. He wanted the company to focus on four things and that was it. According to Isaacson, Jobs had an exceptional ability to focus the company’s vision and get everyone on board with the changes. This removed distractions from the workers and allowed them to focus their attention on doing what they did well. Jobs demonstrated his ability to effectively perform change management within the company. One of the things he did well was create a felt need for change as described in the change management lesson (Thomas N. Barnes Center for Enlisted Education [BCEE], 2017a). Jobs had a way of communicating his vision to get buy in from the company’s members. This is the first step to effective change management (BCEE, 2017a). If Jobs had not been able to accomplish this successfully, the change would’ve been more difficult due to increased resistance from the employees (BCEE, 2017a). Jobs’ actions in this situation helped the company through the vision change. Jobs wanted the products to be perfect. How the Sun Affects the Weather Free Essays

ASTR 1020 August 31, 2011 â€Å"How the Sun Affects the Weather† Our sun is a massive nuclear fusion reactor that generates astonishing amounts of energy. The sun is the largest body in our solar system. It has a gravitational pull causing all other objects in the solar system to orbit it. We will write a custom essay sample on How the Sun Affects the Weather or any similar topic only for you Order Now Since the sun is in the neighborhood of the earth this gives the results of a greater gravitational effect on earth. â€Å"Warmth for the planet is provided primarily by the sun’s energy. The rate of energy coming from the sun changes from day to day. At an average distance from the sun 93 million miles† (Ahrens 4). The energy from the sun affects many things here on earth. One of the main things the sun does is warm our planet, including the atmosphere. This energy drives our weather we see daily. Temperature fluctuation the sun generates can be associated to every weather phenomenon on earth and can be traced back to the sun. All planets have an atmosphere, a layer of gases that surrounds them. The Sun’s atmosphere is made up of hydrogen, while Earth’s is made up primarily of nitrogen and oxygen. Carbon dioxide, ozone, and other gases are also present. These gases keep our planet warm and protect us from the direct effects of the Sun’s radiation. Without this regulation, Earth could not sustain life. To understand the weather you need to understand the layers of the atmosphere. The layers of the atmosphere from the surface rising upward are troposphere, stratosphere, mesosphere, thermosphere, and exosphere. We live in the troposphere layer, this is where the air temperature normally decreases with height, and contains all of the weather we are familiar with. Most of the clouds you see in the sky are found in the troposphere, and this is the layer of the atmosphere we associate with weather. Extending up to 10 miles above Earth’s surface, the troposphere contains a variety of gases: water vapor, carbon dioxide, methane, nitrous oxide, and others. These gases help retain heat, a portion of which is then radiated back to warm the surface of Earth. In the stratosphere is where most of the gas ozone is found. The coldest layer in the atmosphere is the mesosphere and the warmest atmospheric layer is the thermosphere. Then we get to the region where atoms and molecules shoot off into space in the exosphere, which signify the upper limits of our atmosphere. A greenhouse gas in an atmosphere that absorbs and emits radiation withing the thermal infrared range. The primary greenhouse gases in the Earth’s atmosphere are water vapor, carbon dioxide, methane, nitrous oxide, and ozone. Greenhouse gases greatly affect the temperature of the Earth; within them, Earth’s surface would be on average of about 33 degrees Celsius or 59 degrees Fahrenheit colder than present temperature. The earth being tilted at 23. 5 degrees on its axis and revolving around the sun makes the earth’s heat unevenly giving us different climate and weather. â€Å"The tilt causes annual variation in the amount of sunlight that strikes the surface as well as variations in the length of time the sun shines at each latitude† (Ahrens 73). The sun heats up the equatorial regions more than the poles, so the earth has to develop circulations to distribute the heat. This keeps the equator from getting hotter and the poles from getting colder. This is the way the earth balances out its unequal distribution of heat. With the earth’s rotation this causes the wind pattern to form east -to-west. Weather as a whole comes down to the universal circulation of cold and hot air. The sun has the greatest impact on the lower stratosphere with the impact of ultraviolet light from the sun assist in changing temperature. â€Å"Lower to mid stratosphere is heated greatly due to the ozone layer†¦ ozone absorbing large quantities of dangerous solar energy†¦ he absorption causes the warmup from 20km to 50k. The middle and upper troposphere is indeed very important for stability processes. The hotter the surface temps and the colder the mid and upper tropospheric temps†¦ the more instability†¦ and the stronger updrafts and stronger storms† (Haywood). Here are several examples: The sun warms up air, the area encompassing this warm air creating a warm front. Many weather developments will occur when a warm fro nt meets up with a cold front. Ocean’s, lakes, and soil surfaces are warmed by the sun causing warm air to rise in the atmosphere. The warm air meets up with colder air causing it to condense and produce clouds that could create hail, snow, or rain. Sun warm up air over the sea near the equator and this warm air will rise creating a cloud. Cold air will then replace the warm air that has lifted and collides creating spiraling turbulence known as a hurricanes. Sun produces warm air then it abruptly turns cold; this creates pressure and uproar which whips up a tornado. Sun warms up the earth’s surface and this warm air will expand and rise, as it rises the air will then cool and descend. This up and down cycle of rising warm air and descending cool air will generate wind. There are many factors when it comes to weather but the main key to the weather equation is the heating from the sun for weather to occur. The sun plays a vital role in our daily lives and weather.
