Supreme court cases Essay Example | Topics and Well Written Essays - 750 words
Supreme court cases - Essay Example Dissent opinions among the judges suggest potential existence of flaws and that the judgment could be wrong. This paper reviews the Supreme Court decision on the case of Roe v. Wade with the opinion that the court erred in its decision. The case involved decision on legality of abortion based Texas laws that prohibited abortion. The court ruled against state law and explained that a woman has a right to abortion. The Supreme Court further stated that this right was constitutional, derived from two amendments of the United Statesââ¬â¢ constitution. ââ¬Å"The Ninth and Fourteenth Amendments,â⬠the court explained, provide for the right to ââ¬Å"personal privacy,â⬠and grants a woman the sole right to make decisions on reproductive issues (United States Confederation of Catholic Bishops 1). The court further explained that the fetus lacks personality and therefore does not have a right to life, an argument to the effect that abortion does not amount to any element of murd er. The court however established a strategy for determining the rights of a woman and rights of the state regarding abortion in which the state has no right over abortion in the first three months of pregnancy. The decision granted the state limited right to protecting the motherââ¬â¢s rights in the second trimester and right in the fetusââ¬â¢ life in the last three months of pregnancy (Gerber 181). ... Interpreting the Tenth amendment together with the Ninth amendment grants states the power to make laws on abortion. The Ninth amendment is clear that recognized rights in the constitution shall not be interpreted to impair another right but the Texas law on abortion was not specifically based on a right. Even though the law prohibited abortion unless the motherââ¬â¢s life was in danger, secondary rights such as rights of the fetus were not primary to the law. This means that the Ninth amendment that limits interpretations of some rights to disadvantage others should have not been applied against the abortion law and abortion laws, having not been provided for by the constitution, should fall within jurisdiction of states (Rechtschaffen and Markell 41). Provisions of the Fourteenth amendment also appear ambiguous to have warranted the Supreme Courtââ¬â¢s decision to legalized abortion. While the amendment provides that states should not enact laws that infringe peopleââ¬â¢s rights, the amendment fails to recognize limits of peopleââ¬â¢s rights and unless interpreted will other laws, is repugnant to natural justice and other peopleââ¬â¢s rights. If, for example, that a personââ¬â¢s right is a threat to other people then care must be taken to limit such a right. While this argument does not rely on possible rights of the fetus, it notes that independent reliance on the Fourteenth amendmentââ¬â¢s provision for supremacy of constitutional rights was not the right basis. The Texas abortion law would fall under cases of misused Fourteenth amendment rights towards injustice (Miller and Jentz 9). The courtââ¬â¢s decision is also contradictory because it reprimanded the Texasââ¬â¢ abortion law for infringing womenââ¬â¢s rights but at

The cruel princess :: essays research papers
Essay Question: After days and nights of anguished deliberation", the princess makes her decision of what door she will direct the young man to. What do you think her decision is? Explain, using evidence from the story, to support your opinion. The only crime of the young man was that he loved the princess. Just because of this he was forced to play the game of life and death by the barbaric, uncivilized king who never valued human lives. The king's method of trying criminal was that he had two doors in an arena and behind one door there was a hungry, savage tiger and behind the other a woman picked by him. If the accused person opened the door with the tiger, he was eaten. If he opened the door with the lady - he had to marry her with out any complaints. The accused young man had to depend on the princess's decision, who could've saved the young man's life by telling him which door to open. I think the princess directed the young man to the door of death. The princess that we are talking about was the daughter of the king, so it is easy to see that barbarism was in her blood. She knew the woman that the king picked for the young man and she hated her. The princess believed that the woman that was picked was trying to have an affair with the young man from the begining and the princess never wanted something like this to happen. If she cann't even see the young man talking to some other woman then how can she watch him get married with some one who she hated? To the princess it was not a question of saving the young man from the jaws of death, it was about her own win.

John & John Case
I. Problem: The major issue that Johnson& Johnson (J&J) faces with its face powder is that despite the productââ¬â¢s innovation, a toiletry design and confidence in potential customers, it positions its product line as a cheap skin refresher by using supermarkets as main distributing channels and setting the price range of product cheaper compared to that of competitors sold in department stores, which damages its brand and profits. In order to ensure that J&J makes a success in launching new brand category product with profits, it needs to develop a marketing strategy to make more profits by changing its distribution channels, the price range higher and targeted customers under the toiletry concept. II. Alternatives: ) Position as a premium refresher through department stores channels + Raise awareness of a new product as a premium brand by severing relation with baby powder + Higher margin and potential to raise prices above original margins + Successful upper and middle level cu stomers targeting with high value brand and synergy with J&J brand ââ¬â High price and little difference with cosmetics may be unattractive to teen and young adults ââ¬â Fierce Competition with current face powders sold (ex: Angel Face) in the department stores ââ¬â Losing opportunity to use established strong distribution strength in supermarket channels ) Position as a premium refresh for both young female and adults through department stores + Enlarging market by targeting both teen and young adults and older female, including mothers + Less pressure from motherââ¬â¢s opposed to their daughterââ¬â¢s using cosmetic face powder from compacts + End userââ¬â¢s enhanced purchasing power resulting from targeting older females ââ¬â Young customerââ¬â¢s alienation from the product due to their tendency not sharing with old generations ââ¬â More designs and functions for satisfying different kinds of customers in terms of age ââ¬â Unpromising forecast a bout current cosmetic userââ¬â¢s transition into new product category ) Position as a premium refresher for young adults through supermarket channels + Easy access to the product from potential customers + Differentiation from household items sold in the supermarkets due to high price and premium brand + Strong distribution power by usage of already established supermarket distribution channels ââ¬â Difficulty in separating its image from grocery items in the supermarkets ââ¬â Small profit margins compared to that of department stores ââ¬â Huge advertising cost is unnecessary, unprofitable and ineffectiveIII. Recommendation: I suggest that J&J set a new product line as a premium refresher with higher price by distributing it through department stores. At first, the demand of targeted customers such as teens and young adults is already verified. In order to make more profit with this product, J&J needs to target the market segmentation more specific.Considering most po tential customers are young females living in urban areas with relative economic capability, more profit margin in department stores compared to supermarkets, and a marketing strategy under the toiletry concept, I recommend that J&J change its distribution channel into department store and set the price range higher than the current competitors in the market, thus resulting in more profit margin and boosting an image of brand new product as premium items among young adults-main target customers-in the Philippines. In addition, high end strategy will pave the way for launching J&Jââ¬â¢s future youth lines such as body care product with high profit margin and providing high brand image with future customers to J&Jââ¬â¢ baby products, not mention to more profit margin and enhanced J&Jââ¬â¢s premium brand resulting from department stores distribution.
